SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Establishes energy efficiency program within Housing and
Community Services Department. Specifies purposes of program
funding.
Appropriates moneys to department for 2009-2011 biennium for
purposes of carrying out program.
A BILL FOR AN ACT
Relating to energy efficiency in low income housing; and
appropriating money.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Housing and Community Services
Department shall establish a program to provide funding for
energy efficiency improvements in the housing of people of low
income and very low income, both as defined in ORS 458.610.
(2) The program shall provide funds only when the funds from
the program are matched with an equal amount of in-kind
contributions related to energy efficiency improvements,
including but not limited to weatherization services, with an
equal amount of funds from public or private grants, loans, bonds
or cash, or with tax incentives. + }
SECTION 2. { + In carrying out the provisions of section 1 of
this 2009 Act, the Housing and Community Services Department
shall ensure that the program promotes one or more of the
following:
(1) Efforts to advance energy efficiency that are initiated
prior to the construction of housing for people of low income and
very low income, including but not limited to building
assessments and integrated design processes;
(2) Construction that encourages energy efficiency, on-site
energy generation or the use of materials and design that promote
environmental protection;
(3) Energy efficiency programs that focus on weatherization for
the housing of people of low income and very low income;
(4) Energy audits for the housing of people of low income and
very low income; and
(5) Energy efficiency educational programs for consumers. + }
SECTION 3. { + The Housing and Community Services Department
may adopt rules as necessary to implement sections 1 and 2 of
this 2009 Act. + }
SECTION 4. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Housing and Community
Services Department, for the biennium beginning July 1, 2009, out
of the General Fund, the amount of $4 million, which may be
expended for purposes of carrying out sections 1 to 3 of this
2009 Act. + }
